City of McKinney and MCDC File Lawsuit Against McKinney Citizens in Travis County

 McKinney, Texas — The North Texas Conservation Association (“NTCA”) is calling attention to what many residents will see as a shocking and deeply concerning move by the City of McKinney and the McKinney Community Development Corporation (“MCDC”). Did you know the City and MCDC have filed a class action lawsuit against you in Travis County?


While McKinney residents have been fighting for transparency and accountability surrounding the airport expansion project, the City and MCDC have now filed a separate lawsuit in Travis County under a little-known legal process called the Expedited Declaratory Judgment Act (“EDJA”) in an attempt to validate the controversial 2026 airport bonds.


What does this mean for the average McKinney citizen?


It means the City is now asking a Travis County court — nearly 200 miles away from the community most impacted — to approve these bonds through an extremely accelerated legal process before many residents even fully understand what is happening.


The lawsuit effectively treats the taxpayers and citizens of McKinney as defendants in a class action. Public notices in newspapers are considered sufficient “notice” to the public, and any citizen wishing to challenge the bonds is expected to appear in Travis County court within days. A trial has already been scheduled for May 18, 2026.


“This feels like an attempt to take this fight away from the people of McKinney,” NTCA stated. “Residents have repeatedly asked questions about the financial risks, the environmental impacts, the future of our community, and the long-term consequences of airport expansion. Instead of addressing those concerns transparently here in Collin County, the City and MCDC chose to file in Travis County.”


NTCA has already filed a lawsuit in Collin County challenging the controversial 2026 airport bonds. NTCA’s lawsuit was filed long before the City and MCDC filed their EDJA case in Travis County. NTCA believes the new case is blatant forum shopping designed to move the case away from local citizens and local scrutiny.


“This should concern every taxpayer in McKinney regardless of where they stand on airport expansion,” NTCA stated. “People deserve the right to have their voices heard in their own community — not rushed through a legal process happening far away from the residents who will live with the consequences.”


NTCA and its legal team are now preparing to respond in Travis County and will seek to have the EDJA case dismissed.
