Hearing on McKinney Airport Lawsuit Cancelled Following Agreement to Abate Case

The hearing that had been scheduled for today in the Travis County lawsuit involving the City of McKinney and the Texas Attorney General will no longer take place after the parties submitted an agreed order asking the court to abate the case.

The agreement follows the North Texas Conservation Association’s Motion to Abate, which argued that the Travis County lawsuit should be paused while litigation continues in the case NTCA filed in Collin County, since the Collin County case was filed first. The City’s decision to join in an agreed order seeking the same outcome requested by NTCA represents a victory for NTCA and an important development in the litigation. Rather than proceeding with today’s hearing, the parties jointly informed the court that an agreement had been reached, making the hearing unnecessary.

This is an encouraging step forward.

The arguments raised in NTCA’s Motion to Abate have now been acknowledged through an agreed order submitted to the court. While this is not the end of the case, it is an important procedural victory that allows the Collin County case to move forward. NTCA defeated the City’s effort to move the litigation to Travis County.
